These Terms and Conditions and Purchase Agreement govern purchases, use of our website, research-use products, customer responsibilities, store policies, and related services provided by Quest Molecular Peptides.
They contain important information about your rights and obligations, including restrictions on the use of products, disclaimers of warranties, limitations of liability, and indemnification obligations. By placing an order or purchasing any product from Quest Molecular Peptides, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Purchasers must meet applicable age and research requirements.
Materials are supplied solely for qualified laboratory research.
Buyers are responsible for lawful handling, storage and use.
Terms include purchase, returns, payments and shipping provisions.
Purchase Agreement
This Purchase Agreement, together with the Website Terms and Store Policies in Part II (collectively, this “Agreement”), governs the purchase and sale of products and services offered by Quest Molecular Peptides through its website (the “Site”).
Quest Molecular Peptides is referred to as “Quest Molecular Peptides,” “we,” “us,” or “our,” and the customer purchasing or obtaining products is referred to as the “Buyer” or “you.”
The purpose of this Agreement is to establish the conditions and restrictions governing the sale and purchase of Material. By placing an Order through the Site, creating an account, or otherwise purchasing or obtaining Material, you agree to be bound by this Agreement.
If you do not agree to these Terms, you may not order or obtain Material from Quest Molecular Peptides.
We may revise this Agreement by posting an updated version on the Site. Revised Terms take effect as of the posted “Last Updated” date, subject to applicable law.
For purposes of this Agreement:
- “Material” means any product and/or service that Buyer purchases or obtains from Quest Molecular Peptides, including, without limitation, research compounds, peptides, proteins, liquids, powders, chemicals, reagents, labware, and hardware.
- “Affiliate” means any entity that controls, is controlled by, or is under common control with Quest Molecular Peptides, together with its respective officers, directors, employees, agents, and representatives.
- “Qualified Researcher” means a person who is at least twenty-one (21) years of age and possesses the professional training, technical qualifications, and facilities necessary to handle, store, and use Material safely and lawfully for Research Purposes.
- “Research Purposes” means bona fide in vitro laboratory research, analytical, and development activities conducted by qualified personnel. Research Purposes expressly exclude clinical, diagnostic, or human-subject research and any use in or on the human or animal body.
- “Order” means Buyer’s request to purchase Material submitted through the Site.
3.1. ALL MATERIAL OFFERED ON THE SITE IS SOLD FOR LABORATORY AND RESEARCH USE ONLY. MATERIAL IS NOT FOR HUMAN OR ANIMAL CONSUMPTION OF ANY KIND AND IS NOT A DRUG, FOOD, DIETARY SUPPLEMENT, MEDICAL DEVICE, OR COSMETIC.
3.2. Statements made on the Site have not been evaluated by the U.S. Food and Drug Administration. Material and statements concerning Material are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
3.3. Basic scientific research does not include clinical, diagnostic, or human research.
Prohibited uses include, without limitation:
- Human or animal consumption;
- Use as or in a food, drug, dietary supplement, medical device, or cosmetic for humans or animals;
- Use for in vitro diagnostic purposes; or
- Commercial purposes except where expressly permitted under this Agreement.
3.4. Buyer agrees that Material will not be used for human or animal consumption and is intended for Qualified Researchers only.
Quest Molecular Peptides operates as a research chemical and laboratory material supplier.
Quest Molecular Peptides is not represented as a compounding pharmacy under Section 503A of the Federal Food, Drug, and Cosmetic Act (“FDCA”) and is not represented as an outsourcing facility under Section 503B of the FDCA.
Quest Molecular Peptides does not dispense prescription drugs and does not offer Material for the diagnosis, cure, mitigation, treatment, or prevention of disease.
5.1. You must be at least twenty-one (21) years of age to purchase Material through the Site.
By placing an Order, you represent and warrant that you are at least twenty-one (21) years of age, that you are a Qualified Researcher or are purchasing on behalf of one, and, when ordering for an entity, that you have authority to bind that entity to this Agreement.
5.2. Quest Molecular Peptides reserves the right to request proof of age, professional qualification, or institutional affiliation and may refuse, limit, suspend, or cancel an Order or account if eligibility requirements are not satisfied or information provided is false, incomplete, or misleading.
Subject to this Agreement, Quest Molecular Peptides conveys to Buyer a limited, non-exclusive, non-transferable, revocable right to use the purchased quantity of Material solely for internal Research Purposes for the benefit of Buyer.
No right to resell Material or any of its components is conveyed expressly, by implication, or by estoppel.
Material is for internal Research Purposes only and is not intended for commercial applications unless expressly authorized in writing by Quest Molecular Peptides.
7.1. Buyer shall not, directly or indirectly:
- Use Material for a purpose other than Research Purposes;
- Resell, repackage, relabel, or use Material as a component of another product except as expressly authorized;
- Export or re-export Material contrary to applicable law; or
- Provide Material to a third party except as expressly permitted by this Agreement.
7.2. If Buyer intends to sell, supply, repackage, relabel, use as a starting material or component, or otherwise provide Material to a third party, Buyer must first provide sufficient information concerning the proposed recipient and obtain Quest Molecular Peptides’ express written approval.
7.3. Quest Molecular Peptides reserves the right to limit quantities or decline to sell Material to customers it determines do not satisfy applicable requirements.
Buyer represents and warrants to Quest Molecular Peptides that:
8.1. Buyer has independently reviewed and understands health and safety hazards associated with handling Material, necessary industrial hygiene controls, warning requirements, and applicable government regulations.
8.2. Buyer will properly test and use Material in accordance with the practices expected of a qualified expert in the relevant scientific field and in compliance with applicable federal, state, and local laws and regulations.
8.3. Material will be handled only by Qualified Researchers and other appropriately qualified and trained individuals.
9.1. Buyer is responsible for ensuring that any materials produced using Material purchased from Quest Molecular Peptides comply with applicable law, including applicable requirements of the FDCA.
9.2. Because Material may be intended primarily for Research Purposes, Buyer is responsible for determining and satisfying any applicable requirements under the Toxic Substances Control Act (“TSCA”), including determining whether an exemption or authorization is required.
9.3. Buyer is solely responsible for compliance with applicable export-control laws and regulations and shall not export or re-export Material in violation of those requirements.
Buyer acknowledges that hazards may be associated with the handling and use of Material.
Buyer is responsible for verifying hazards and conducting additional research reasonably necessary to understand risks associated with the handling, storage, use, and disposal of Material.
Buyer is responsible for appropriately warning its own personnel, customers, contractors, freight handlers, or other persons who may encounter Material concerning applicable risks.
Buyer agrees to comply with applicable instructions supplied by Quest Molecular Peptides and not to misuse Material.
11.1. MATERIAL IS PROVIDED “AS IS” AND “WITH ALL FAULTS.” QUEST MOLECULAR PEPTIDES HAS NOT TESTED MATERIAL FOR SAFETY OR EFFICACY IN FOOD, DRUG, MEDICAL DEVICE, COSMETIC, COMMERCIAL, HUMAN, ANIMAL, OR OTHER UNAUTHORIZED USE.
11.2. TO THE FULLEST EXTENT PERMITTED BY LAW, QUEST MOLECULAR PEPTIDES MAKES NO WARRANTIES OF ANY KIND WITH RESPECT TO MATERIAL, WHETHER EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.3. Some jurisdictions do not allow exclusion of certain warranties. Accordingly, some exclusions may not apply where prohibited by law.
12.1. TO THE FULLEST EXTENT PERMITTED BY LAW, QUEST MOLECULAR PEPTIDES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST REVENUES, OR DIMINUTION IN VALUE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR MATERIAL.
12.2. QUEST MOLECULAR PEPTIDES’ TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO MATERIAL SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY BUYER FOR THE MATERIAL GIVING RISE TO THE CLAIM.
12.3. Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.
In consideration of the sale of Material to Buyer, Buyer agrees, to the fullest extent permitted by law, to indemnify, defend, and hold harmless Quest Molecular Peptides and its Affiliates from claims, demands, actions, proceedings, losses, damages, fines, penalties, liabilities, costs, and reasonable attorneys’ fees arising out of or relating to:
- Buyer’s handling, storage, testing, use, or disposal of Material;
- Buyer’s breach of this Agreement or any representation or warranty;
- Buyer’s violation of applicable laws or regulations;
- Regulatory action arising from Buyer’s activities; or
- Buyer’s unauthorized sale, supply, or transfer of Material to a third party.
14.1. Quest Molecular Peptides does not warrant that use or sale of Material will not infringe any United States or foreign patent or other intellectual property right.
Listing Material on the Site does not constitute a license or recommendation to use Material in infringement of any patent.
14.2. No license under any patent, trademark, copyright, or other intellectual property right of Quest Molecular Peptides is granted or implied through the sale of Material, except the limited permitted use expressly provided under this Agreement.
As between the parties, Buyer retains ownership of research data and results generated through Buyer’s permitted research activities, subject to applicable law.
This Agreement and disputes arising out of or relating to it shall be governed by applicable law and the laws applicable to Quest Molecular Peptides’ legal place of organization, without regard to conflict-of-law principles, except where another law is required to apply.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to the extent its exclusion is legally permitted.
16.1. Venue. Subject to applicable consumer-protection laws and mandatory jurisdiction requirements, disputes arising under this Agreement shall be brought in a court of competent jurisdiction associated with Quest Molecular Peptides’ legal place of organization or another jurisdiction agreed to by the parties.
16.2. Fees. Where permitted by applicable law, the prevailing party in an action relating to this Agreement may be entitled to recover reasonable attorneys’ fees, filing fees, and costs.
16.3. Consumer Reviews. Nothing in this Agreement restricts or penalizes lawful reviews, feedback, or assessments by Buyer regarding Quest Molecular Peptides or Material.
Quest Molecular Peptides reserves rights available under law regarding unlawful, defamatory, fraudulent, or knowingly false content.
17.1. Entire Agreement. This Agreement, together with applicable Order confirmations, Privacy Policy, Shipping and Returns Policy, and other incorporated policies constitutes the agreement between the parties concerning its subject matter.
17.2. Amendment; No Waiver. Quest Molecular Peptides may update posted Terms as described in Section 1. Failure or delay in exercising a right does not constitute a waiver.
17.3. Severability. If any provision is determined to be invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and remaining provisions remain effective.
17.4. Assignment. Buyer may not assign this Agreement without the prior written consent of Quest Molecular Peptides, except where applicable law provides otherwise.
17.5. Force Majeure. Quest Molecular Peptides is not liable for delay or failure resulting from causes beyond its reasonable control, including natural disasters, labor disputes, supply shortages, carrier delays, governmental actions, or failures of third-party service providers.
17.6. Notices. Notices to Quest Molecular Peptides may be sent to:
Notices to Buyer may be sent to the email or postal address associated with Buyer’s account or Order.
17.7. Relationship of the Parties. The parties are independent contractors. Nothing in this Agreement creates a partnership, joint venture, agency, employment relationship, or research-development relationship unless expressly agreed otherwise in writing.
17.8. Headings. Headings are included for convenience and do not alter interpretation.
Website Terms & Store Policies
Unless otherwise specified, materials appearing on the Site, including text, design, logos, graphics, icons, images, product descriptions, arrangement, and other website content, are owned by or licensed to Quest Molecular Peptides.
Site content may be used only for lawful interaction with Quest Molecular Peptides and placing Orders.
Materials may not be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed without prior written permission except where permitted by applicable law.
All rights not expressly granted are reserved.
Receipt of an electronic or other Order confirmation does not necessarily signify acceptance of the Order or constitute final confirmation of an offer to sell.
An Order constitutes Buyer’s offer to purchase.
Orders remain subject to acceptance by Quest Molecular Peptides, and we may accept, decline, limit, suspend, or cancel an Order where legally permitted.
Confirmation communications may confirm receipt of an Order without constituting final acceptance.
Prices are subject to change without notice.
The applicable price is generally the price displayed on the Site when the Order is placed.
If a product is listed at an incorrect price due to typographical, technical, or pricing information error, Quest Molecular Peptides reserves the right, where permitted by law, to refuse or cancel Orders placed at the incorrect price.
If payment has already been collected for an Order canceled because of an incorrect listed price, an applicable refund will be processed.
Quest Molecular Peptides accepts payment methods identified during checkout.
Buyer should provide accurate billing information corresponding with information associated with the chosen payment method. Incorrect information may delay or prevent processing.
Buyer represents and warrants that payment information provided is accurate, complete, and authorized for use.
Charges may appear on Buyer’s statement using a billing descriptor associated with Quest Molecular Peptides or its authorized payment-processing provider.
Any applicable processing or transaction fee will be disclosed where required before completion of the Order.
Orders are processed according to the shipping options, processing times, carrier schedules, inventory availability, and Shipping and Returns Policy displayed on the Site.
Shipping and transit times are estimates and cannot be guaranteed. Carrier delays, weather, holidays, service interruptions, incorrect addresses, and circumstances outside our reasonable control may affect delivery.
Unless otherwise stated during checkout or in an Order confirmation, Buyer is responsible for applicable shipping and handling charges.
Products are fulfilled subject to inventory availability.
If an ordered product is out of stock, fulfillment may be delayed, substituted where expressly authorized, or canceled as appropriate.
Order modifications and cancellations are subject to the applicable Shipping and Returns Policy and the processing status of the Order.
Due to the nature of Material, certain products may be non-returnable.
Except for products designated as non-returnable, eligible unopened products in original condition may qualify for return or refund according to the Shipping and Returns Policy displayed on the Site.

Buyer is responsible for applicable return-shipping costs unless Quest Molecular Peptides expressly states otherwise.
Buyer should use a trackable shipping method for approved returns and remains responsible for the return shipment until received.
Quest Molecular Peptides may collect and remit applicable sales, use, or similar taxes when required by applicable law.
Where Quest Molecular Peptides is not legally required to collect an applicable tax, Buyer remains responsible for any tax obligation imposed on Buyer by the relevant jurisdiction.
26.1. Opt-In and Consent. By affirmatively opting in to receive SMS communications from Quest Molecular Peptides, you consent, where permitted by applicable law, to receive recurring automated marketing or informational text messages at the mobile number provided.
26.2. Not a Condition of Purchase. Consent to receive marketing text messages is not a condition of purchasing goods or services.
26.3. Rates and Frequency. Message and data rates may apply. Message frequency may vary.
26.4. Opt-Out and Help. You may opt out of applicable SMS communications by replying STOP. Reply HELP where supported or contact:
26.5. Delivery. Messages may be sent from dedicated toll-free, short-code, local, or other messaging numbers. Wireless carriers and Quest Molecular Peptides cannot guarantee immediate or uninterrupted message delivery.
Quest Molecular Peptides may collect and process personal information including name, email address, payment-related information, shipping or billing address, phone number, transaction information, and account credentials as described in our Privacy Policy.
Information may be used to process and fulfill Orders, communicate with customers, secure the Site, provide support, and personalize applicable customer experiences.
Depending on applicable law and place of residence, consumers may have rights to access, correct, delete, or control certain uses or disclosures of personal information.

The Site may contain links to websites or services operated by third parties that Quest Molecular Peptides does not own or control.
Quest Molecular Peptides is not responsible for the content, operation, data collection, privacy practices, or security practices of third-party sites.
Customers should review applicable third-party policies before submitting information to those services.
The Quest Molecular Peptides online store may use WooCommerce and related technology to provide e-commerce functionality.
WooCommerce provides software infrastructure and is not responsible for Quest Molecular Peptides’ products, website content, business operations, marketing, or customer transactions.
Product listings, website content, promotional materials, policies, and commercial activities displayed through the Quest Molecular Peptides store are controlled by Quest Molecular Peptides and applicable authorized service providers.
These Terms supersede inconsistent terms or conditions included by Buyer with a purchase order or other document unless Quest Molecular Peptides expressly agrees otherwise in writing.
Quest Molecular Peptides reserves the right to update the Site and these Terms from time to time, subject to applicable law.
To the extent that Part I and Part II conflict, Part I controls regarding the sale, handling, and permitted use of Material.
